Software License Agreement

1. License Grant

Subject to your compliance with this Agreement and payment of applicable license fees, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on macOS devices you own or control, solely for your personal or internal business purposes.

2. Restrictions

You may not:

• Copy, modify, adapt, translate, or create derivative works of the Software, except as expressly permitted by applicable law;
• Reverse engineer, decompile, or disassemble the Software, except to the extent that applicable law expressly permits such activity;
• Rent, lease, lend, sell, sublicense, or distribute the Software or any rights in it;
• Remove or alter any proprietary notices, labels, or marks on the Software;
• Use the Software for any unlawful purpose or in any manner that violates applicable local, national, or international law.

3. Encrypted Data and Passwords — Your Responsibility

You are solely responsible for:

• Creating, storing, and safeguarding all passwords, cryptographic keys, noise-depth (K) settings, and recovery information;
• Maintaining independent, verified backups of all important data and storage files before relying on them;
• Verifying that your backups can be successfully restored;
• Understanding that lost, forgotten, or mistyped passwords cannot be recovered by us or by any other means;
• Any consequences arising from the use of decoy passwords, multiple vaults, or plausible-deniability features.

4. Assumption of Risk

You acknowledge that encryption software, virtual disks, file-system extensions, and steganographic storage involve technical complexity. You assume all risks associated with the Software, including but not limited to:

• Data loss, corruption, or inaccessibility;
• Software bugs, crashes, or compatibility issues arising from macOS updates;
• Hardware failure, power loss, or storage media defects;
• User error, misconfiguration, or improper shutdown;
• Third-party tools that modify, re-encode, or damage carrier files (e.g. lossy audio processing of WAV carriers);
• Actions of malware, ransomware, or unauthorised persons;
• Regulatory or legal obligations in your jurisdiction.

5. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, DATA ACCURACY, QUIET ENJOYMENT, OR THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR FREE OF HARMFUL COMPONENTS.

WE DO NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS, THAT OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT YOUR DATA WILL REMAIN INTACT, ACCESSIBLE, OR CONFIDENTIAL.

Mandatory consumer warranties: Some jurisdictions (including EU member states, the UK, and Australia) provide statutory warranties or guarantees that cannot be excluded by contract. Nothing in this section limits any such statutory rights.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SUNDY DATA LABS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO THIS AGREEMENT OR YOUR USE OR INABILITY TO USE THE SOFTWARE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Without limiting the foregoing, we shall not be liable for any claims relating to:

• Lost, deleted, corrupted, or unrecoverable data;
• Lost or forgotten passwords or encryption keys;
• Failure to maintain adequate backups;
• Accidents, misuse, or negligence by you or third parties;
• System crashes, power failures, or disk errors.

Our total aggregate liability for all claims arising out of or related to this Agreement or the Software shall not exceed the greater of (a) the amount you paid us for the Software license in the twelve (12) months preceding the claim, or (b) fifty United States dollars (US $50).

Some jurisdictions do not allow exclusion or limitation of certain damages, including those arising from gross negligence or intentional misconduct; in such jurisdictions, our liability is limited to the maximum extent permitted by law.

7. Indemnification

You agree to indemnify, defend, and hold harmless Sundy Data Labs and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Software; (b) your data or content; (c) your violation of this Agreement; or (d) your violation of any law or the rights of a third party. This indemnification obligation does not apply to EU or UK consumers in respect of claims arising from our own breach of applicable mandatory consumer law.

8. Termination

This license is effective until terminated. It terminates automatically if you fail to comply with any term. Upon termination, you must cease all use of the Software and uninstall it. Sections 3–7 and 9 shall survive termination. Termination does not delete your encrypted files; you remain solely responsible for access to them.

9. Updates

We may provide updates or modifications to the Software from time to time. Updates may be subject to additional or amended terms which we will present to you before the update takes effect. We are not obligated to provide support, updates, or continued compatibility with any particular macOS version or hardware configuration.

10. Governing Law and Consumer Rights

This Agreement is governed by the laws of Indonesia, without regard to its conflict-of-law principles, subject to the following mandatory overrides:

• EU / EEA consumers: Nothing in this Agreement limits mandatory protections afforded to you under the laws of your EU member state of residence. You retain the right to bring claims before the courts of your country of residence.
• UK consumers: Nothing in this Agreement limits mandatory protections afforded to you under English law or the laws of Scotland or Northern Ireland. You retain the right to bring claims before UK courts.
• Australian consumers: Nothing in this Agreement excludes or restricts your rights under the Australian Consumer Law, including consumer guarantees.

11. Entire Agreement and Severability

This Agreement, together with our Terms of Service and Privacy Policy published at sundy.io, constitutes the entire agreement between you and Sundy Data Labs regarding the Software. If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any right is not a waiver of that right.
